In keeping with NSW’s move towards a 100% digital environment for lodgement of land dealings, the Registrar General has recently declared that from 11 October 2021 all remaining dealings must be lodged electronically and can no longer be physically lodged.

This includes leases.

This announcement comes on the back of the abolition of paper certificates of title and in the midst of temporary amendments to the Conveyancing Rules which allow for the electronic execution of land dealings during the COVID-19 pandemic.

Despite uncertainty about the permanency of the current execution rules (which are due to expire on the 31 December 2021) there is a clear acknowledgement that electronic execution can be done in a secure manner, and we expect further reforms to reflect this and keep step with the changing commercial landscape.

From a practical perspective, the above amendments will significantly increase the efficiency of the lease registration process and, in turn, benefit both lessees and lessors alike.
